MODERN IMPLEMENTS

York Modern Corporation (York) agrees to repair or replace, at its option, its products, if:

1. Defects appear in the product within 90 days after its delivery to its first user;

2. The defects are caused by faulty material or workmanship in manufacture of the product and not to:

a. Acts or neglect of the owner or entities other York,

b. Owner's failure to maintain the equipment in accordance with the instructions in the document to

which this warranty is attached on delivery,

c. Owner's failure to use equipment in a reasonable manner and under normal working conditions;

(NOTE: Rake teeth, scarifier teeth and blades are expected to require replacement periodically. Frequency

will depend on the magnitude and character of use.)

3. Owner mails notice to York of the manner of the defect within 30 days of its discovery by first class mail

addressed to York Modern Corporation, P. O. Box 488, Unadilla, New York 13849, or by a telephone call,

within the same period, to York Modern Corporation (800) 643-YORK or (607) 369-7111, and thereafter

forthwith presents the product for repair or replacement as directed by York in response. If a replacement is

indicated the defective parts must be returned to York.

Except as set forth above, York makes no warranty of its products and agrees to no remedial action on its part

for defects in its products. York specifically disclaims any implied warranties, including implied warranties

of fitness for use and merchantability (unless the product is of a type normally used for personal, family or

household purposes, in which case all implied warranties are effective but limited in duration to the 90-day

period specified above for the express warranty). York specifically disclaims any liability for consequential

damages of any kind arising out of defects in the product except to the extent that such disclaimer is legally

ineffective.

Some states do not allow limitations on how long an implied warranty lasts and some do not allow the

exclusion or limitation of incidental or consequential damages, so the above limitation on the implied

warranty length and the above exclusion of consequential damages may not apply to you.

This warranty gives you specific legal rights, and you may also have other rights which vary from state to

state.
